These Terms and Conditions (“Terms”) govern your access to and use of the NDIS360 website, software platform, and related services (“Services”).

By accessing or using NDIS360, you agree to be bound by these Terms. If you do not agree, you must not use the Services.


1. About NDIS360

NDIS360 is a software-as-a-service (SaaS) platform designed to support NDIS providers with participant management, shift rostering, support coordination, compliance, invoicing, and related operational workflows.

NDIS360 is a technology platform only and does not provide NDIS services, support work, clinical advice, or compliance certification.


2. Eligibility & Account Use

  • The platform is intended for use by NDIS providers and their authorised staff.
  • You must ensure that all users under your account are properly authorised.
  • You are responsible for all activity that occurs under your account credentials.

You must keep your login details secure and confidential.


3. User Responsibilities

By using NDIS360, you agree to:

  • Provide accurate, lawful, and up-to-date information
  • Use the platform in compliance with NDIS rules, guidelines, and applicable laws
  • Ensure participant data is entered and managed responsibly
  • Review and verify all records, reports, and AI-generated content before use
  • Maintain appropriate internal policies and controls

NDIS360 does not replace your legal, regulatory, or compliance obligations as an NDIS provider.


4. Use of AI Features

NDIS360 includes AI-powered features that assist with tasks such as drafting case notes and improving administrative efficiency.

You acknowledge and agree that:

  • AI-generated content is assistive only
  • AI outputs may require review, editing, or correction
  • Final responsibility for accuracy, compliance, and appropriateness remains with the user
  • NDIS360 does not make decisions on behalf of participants or providers

NDIS360 is not liable for actions taken based on AI-generated outputs.


5. Data Ownership

  • You retain full ownership of all data entered into the platform, including participant and employee data.
  • NDIS360 does not claim ownership over your data.
  • You grant NDIS360 a limited licence to process and store data solely for the purpose of providing the Services.

6. Data Security & Storage

NDIS360 implements reasonable technical and organisational measures to protect data, including:

  • Encryption of sensitive data
  • Secure, S3-compatible storage infrastructure
  • Role-based access controls

While strong safeguards are in place, no system can be guaranteed to be completely secure. You acknowledge and accept this risk.


7. Availability of Service

  • We aim to provide reliable and continuous access to the platform.
  • Scheduled maintenance, updates, or unexpected outages may occur.
  • NDIS360 does not guarantee uninterrupted or error-free operation.

8. Fees & Subscriptions (If Applicable)

  • Certain features or services may require a paid subscription.
  • Fees, billing cycles, and payment terms will be disclosed at the time of purchase.
  • Failure to pay fees may result in suspension or termination of access.

9. Acceptable Use

You must not:

  • Use the platform for unlawful or unethical purposes
  • Upload malicious code or attempt to compromise system security
  • Access data you are not authorised to view
  • Misuse participant or employee information

Violation of acceptable use may result in suspension or termination.


10. Termination & Suspension

NDIS360 may suspend or terminate access if:

  • These Terms are breached
  • The platform is misused
  • Required fees remain unpaid

Upon termination:

  • Access to the platform may be disabled
  • Data handling will follow our Privacy Policy and legal obligations

11. Limitation of Liability

To the maximum extent permitted by law:

  • NDIS360 is not liable for indirect, incidental, or consequential losses
  • We are not responsible for compliance breaches resulting from incorrect data entry or misuse
  • Our total liability is limited to the amount paid for the Services in the preceding 12 months

12. Indemnity

You agree to indemnify and hold harmless NDIS360 against claims, losses, or damages arising from:

  • Your misuse of the platform
  • Breach of these Terms
  • Violation of laws or NDIS obligations

13. Changes to These Terms

We may update these Terms from time to time. Updated versions will be published on our website with a revised date.

Continued use of the Services constitutes acceptance of the updated Terms.


14. Governing Law

These Terms are governed by the laws of Victoria, Australia.
